01 Acceptance
By downloading, installing, or using Wendmark, you agree to these Terms of Use. If you don't agree, don't use the app. We may update these terms from time to time (see §11); if a change is material, the app will ask you to re-accept before you can keep using it.
02 License
Wendmark grants you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your own personal, non-commercial recordkeeping. You may not reverse-engineer, redistribute, resell, sublicense, or use the app to build a competing product, except to the extent applicable law says we can't stop you.
03 Subscriptions & billing
Some Wendmark features are part of Wendmark Premium, an optional auto-renewable subscription. Core journaling — adding places manually, attaching photos, viewing your library, widgets, and export — does not require a subscription, and everything you've already saved stays viewable and exportable even if a subscription ends.
- Plans & price. Premium is offered monthly and annually; the exact price is shown in the app before you buy and may vary by region. Where offered, a free trial converts to a paid subscription at the end of the trial unless cancelled at least 24 hours before it ends; any unused portion of a free trial is forfeited when you purchase a subscription.
- Billing. Payment is charged to your Apple ID at confirmation of purchase, handled entirely by Apple. Wendmark never sees or stores your payment details.
- Auto-renewal. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends, at the then-current price for your plan.
- Managing & cancelling. Manage or cancel any time in your App Store account settings (Settings → your name → Subscriptions on iOS, or App Store → account → Account Settings on macOS), or from the Manage Subscription link inside Wendmark. Deleting the app does not cancel a subscription.
- One subscription, both platforms. A single Premium subscription unlocks Wendmark on iOS and macOS under the same Apple ID.
- Price changes. If the price of your plan increases, Apple will notify you in advance and, where required, ask for your consent before the new price applies.
- Refunds. Purchases are processed by Apple, and refunds are governed by Apple's App Store terms — request one at reportaproblem.apple.com. We can't issue App Store refunds ourselves.
- When a subscription ends. Premium features stop working, but your library remains fully viewable and exportable, and iCloud sync of your existing data continues. We never delete your data because a subscription lapsed.
04 What Wendmark is
Wendmark is a personal journal for places you've been and places you want to go. It is not a review platform, a travel authority, or a source of professional advice. Specifically:
- Your place data — names, notes, ratings, photos, and category details — is exactly what you entered. We don't verify, fact-check, or curate it.
- AI-generated content (Smart Capture, natural-language search, the "Year in Places" recap, wishlist suggestions) is produced by an on-device model and may be incomplete, wrong, or oddly phrased. Treat it as a drafting aid, not a source of truth — review anything it writes before relying on it.
- Third-party lookups — TripAdvisor Content API results and ESPN/MLB Stats game data — are fetched live from those services. Wendmark doesn't control their accuracy, availability, or completeness, and a result being shown in the app isn't an endorsement of it.

05 Your TripAdvisor API key
TripAdvisor lookups are optional and require you to supply your own TripAdvisor Content API key and Referer value in Settings. That key is yours: you're responsible for obtaining it under TripAdvisor's own developer terms, for any usage limits or costs TripAdvisor attaches to it, and for keeping it to yourself. Wendmark stores it in your device's keychain and never transmits it anywhere except directly to TripAdvisor's API when you trigger a lookup.
06 iCloud sync isn't guaranteed
Wendmark syncs your library between your own devices through your private iCloud account. Sync depends on Apple's CloudKit service, your network connection, and your iCloud storage — all outside our control. We don't guarantee sync will always succeed, always be timely, or never lose data in a worst-case failure (a corrupted local store, an iCloud account issue, a botched device migration).
Keep your own backups. Use Settings → Library → Export (Full Backup includes your photos) periodically, especially before major iOS/macOS upgrades, device transfers, or if you're relying on Wendmark for anything you'd be upset to lose.
07 "As is," no warranty
Wendmark is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory — including, to the fullest extent permitted by law, any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the app will be uninterrupted, error-free, or secure. We don't warrant the accuracy of AI-generated content, third-party lookup results, or geocoding/mapping data.
08 Limitation of liability
To the fullest extent permitted by law: Wendmark and its developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the app — even if advised of the possibility of such damages.
Where liability can't be excluded, our total liability to you for all claims arising from or related to the app will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US $50.
Nothing in these terms limits liability where doing so is prohibited by applicable law.
09 Indemnification
You agree to indemnify and hold harmless Wendmark's developer from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the app, your violation of these terms, or your violation of any third party's rights (for example, misuse of a TripAdvisor API key or content you attach to a place).
10 Termination
You can stop using Wendmark at any time by deleting the app. We may suspend or terminate your ability to use the app if you violate these terms. Because your data lives in your own iCloud account and on your own devices (see the Privacy Policy), termination doesn't give us any access to or control over data you've already stored — deleting the app and, if you choose, your iCloud data is entirely in your hands.
11 Changes to these terms
We may revise these terms as the app evolves. Non-material changes (clarifications, typo fixes) take effect when posted. If we make a material change — one that meaningfully changes your rights or obligations — the app will require you to review and re-accept the updated terms in-app before you can continue using it. The "Effective" date at the top of this page reflects the most recent change.

12 Governing law
These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws principles, and any dispute arising from them will be resolved in the state or federal courts located in New York, to the extent not otherwise required by applicable consumer-protection law where you live.
